Terms and Conditions

Returns (Watches) 

​If a watch has been knowingly serviced or inspected it will state as such in the description. Each watch is checked by trusted watch experts. 

 Given the age of these items, servicing is recommended and the responsibility of the buyer.

 All sales are final upon checkout. However, if an item arrives not as described or misrepresented, you will be entitled to return the item for a full and proper refund. Please email admin@theshrewshop.com for the address and for any other information on our full return policy. 

 Shipping 

We aim to process and post your order within 1-3 working days. Please note that we are a small business and endeavour to send items as quickly as possible. 

 We can assist with shipping worldwide with shipping services. Quotes will be provided on request. 

 INTERNATIONAL CUSTOMS AND DUTY:

​All responsibility for deliveries subject to customs charges / sales tax or any quarantine checks which may be in place in certain countries lie with the purchaser. Please check with your local authority before committing to purchase.

​The Shrew will pack your watch securely and only ship to your agreed chosen address. We reserve the right to request Identification.

They will be dispatched via Royal Mail recorded delivery or preferred other by request.

Overseas orders will be sent fully insured via DHL Express or FedEx International (or please let us know if you have a preferred alternative carrier before purchasing) - shipping cost calculated at checkout.

We will accept cancellation of your order for items that have not shipped. Once the items are shipped, no cancellation will be accepted. It is the responsibility of the buyer to pay any inbound duties and taxes which your local customs authority deems appropriate

All Goods must be paid for in full, prior to dispatch

​The Shrew Terms of Business 

 (The Shrew trading as a business name under Katherine Lacey) 

 By purchasing Goods from us, you agree to be bound by our Terms.  

Definitions  

In these Terms of Business the following expressions shall where the context  

so admits have the following meanings respectively  

 Buyer/You means the Buyer of an item from a Seller through the agency of  The Shrew or of an item owned by The Shrew  

Item means watches and associated paraphernalia, possibly including box and paperwork, straps and/or accessories  as specified in any Transaction.  

​The Shrew/We/Us means Katherine Lynn Lacey acting as a sole trader under the trading name ‘The Shrew’  

Seller/You means The Shrew or an undisclosed seller of an Item through the agency of The Shrew  

Transaction means the sale and purchase of an Item  

​Terms applicable to Buyers:  

​1. The Shrew acts at all times as agent for the Seller or on their own behalf as Seller. Unless otherwise agreed sales of Items result in contracts made between the Seller, directly or through the agency of The Shrew, and the Buyer.  

​2. On payment of the full amount including shipping fees and any ancillary costs by the Buyer to The Shrew the Item will be shipped by The Shrew to the Buyer. Full condition reports, certificates of attribution, insurance certificates and any other reports requested by the Buyer can be requested in advance of shipping and will be charged at our standard fees. Written reports and opinions provided by The Shrew are given in good faith and are expressions of opinion only. The Shrew shall not be liable to the Buyer for any statements made in such reports which may subsequently be found to be inaccurate or incomplete. Nor shall any reports or opinions of The Shrew be used to settle any disputes between the Buyer and third parties in which The Shrew has no involvement.  

​3. Insurance during shipping is covered in the shipping fee which is not refundable or optional. Shipping costs will be paid by the Buyer including insurance. 

​4. Any restoration or alteration of the Item by the Buyer whilst in their  

possession or that of a third party authorised by the Buyer will be taken as acceptance of the Item under every circumstance and regardless of timescale.  

 5. Title to the Item shall pass on full payment of the purchase price, shipping fee and any other ancillary cost. 

 6. All sales are final upon checkout. However, if an Item arrives not as described or misrepresented,  the Buyer will be entitled to return the Item for a full and proper refund. Due to the nature of pre-loved / vintage, some items may contain minor flaws and show signs of wear. All items are sold as seen and we are always able to provide further measurements and photos if requested. If a watch has been knowingly serviced or inspected it will state as such in the description. Each watch is checked by trusted watch experts.  Given the age of some of the watches and that they are pre-owned, servicing is recommended and the responsibility of the Buyer. 

 7. In the event of a return, to  arrange an exchange or refund please email admin@theshrewshop.com for return address details. We will require you to return the goods in the same condition as dispatched to you and unworn. 

 8. The Shrew shall be entitled to deduct any sums paid by the Buyer in respect of shipping, insurance and any other agreed fees and expenses in order to defray these costs irrespective of the outcome of the Transaction.  

Importation into a Buyer’s destination country  

​9. The Buyer’s inability to import any item into their destination country as a result of Government economic sanctions or other restrictions shall not justify cancellation or rescission of the Transaction or any delay in payment. The Buyer must satisfy themselves before payment as to whether an item is subject to such import restrictions, or any other restrictions on importation or exportation.  

Export and Permits  

10. It is the Buyer’s sole responsibility to identify, obtain, and purchase any  

necessary export, import or other permit for the Item.  

 

Extent of Liability  

 

Neither the Seller, nor The Shrew or its employees or agents give any guarantee or warranty . 

11. Any claim against The Shrew or the Seller by a Buyer is limited to the purchase price with regard to that Item. Neither the Shrew nor the Seller shall under any circumstances be liable for any consequential loss.  

Refund in the case of Forgery  

12. Subject to the provisions of this clause or clauses, a  sale will be cancelled, and the amount paid refunded to the Buyer if an Item sold through The Shrew is proved to the reasonable satisfaction of The Shrew to be a forgery. We shall not however be obliged to refund any amounts if either (a) the description of the Item on our website corresponded to the generally accepted opinion of scholars or experts at the relevant time, or fairly indicated that there was a conflict of opinions; or (b) it can be demonstrated that the item is a forgery only by means of either a scientific process not generally accepted for use until after the item was listed on our website or a process which at the date of listing was unreasonably expensive or impracticable or likely to have caused damage to the Item.  

13. Furthermore, the Buyer should note that this refund can be obtained only  

if all the following conditions are met: (i) the Buyer must notify us in writing, within three months of the Transaction,  

that in their view the item concerned is a forgery; and (ii) before returning the item, the Buyer must produce evidence  

satisfactory to The Shrew (acting reasonably) that the item is a forgery; and (iii) the Buyer must be able to transfer good title to us, free from any third  

party claims.  

14. Within 14 days of these conditions having all been met, the Buyer must return the Item to us in the same condition as it was when it left our care.  

 

15. In no circumstances shall We be required to pay the Buyer any more than the amount paid by him for the Item and the Buyer shall have no claim for interest.  

16. The benefit of clauses 12-15 is not capable of being transferred, and is solely for the benefit of the person to whom the original invoice was made out by us in respect of the Item when sold and who, since the sale, has  remained the owner of the item without disposing of any interest in it to any third party.  

17. The Shrew shall be entitled to rely on any scientific or other process to  

establish that the Item is not a forgery, whether or not such process was used or in use at the date of the Transaction  

Terms applicable to Sellers  

1. The terms set out in this part apply to a Seller whose Item has  

been accepted as suitable for sale by The Shrew.  

2. The Seller agrees that The Shrew will have the sole selling rights to an  

Item listed on its platform and the Item will not be listed on any other site/place/shop/forum or other sale medium. If the Item is found for sale in another location and at a cheaper price, The Shrew reserves the right to drop the price of the Item to the same level and/or withdraw the Item from sale, charging the full fee payable to The Shrew as if the item had been sold at the advertised price.  

3. The Seller agrees to list the Item on The Shrew’s platform for a  

period of three months although the Item may remain on the site for as long as both Seller and The Shrew are happy for it to do so.  

 

4. The Shrew may withdraw an Item from sale at any point and  

without reason or obligation to the Seller.  

5. The Shrew will make no charge for listing the Item for sale on its  

website and will use all reasonable endeavours to procure a sale of the Item. The Shrew has the absolute right to refuse to offer an Item and to withdraw an Item from sale at any time.  

 

6. The Shrew will offer the Seller its opinion on value, this is advisory  

only but Items considered by The Shrew to be overvalued may not be accepted.  

7. The Shrew’s standard commission will be 20% of the sale price plus  

VAT.  

8. Property in and title to the Item shall remain with the Seller at all times until a Transaction for the sale of the Item has been concluded. The Shrew shall (unless otherwise agreed with the Seller) maintain insurance of the Item for a sum agreed to be the estimated value of the Item for the period commencing when the Item has been collected by or delivered into the possession of The Shrew, and ending when the net sale proceeds are remitted to the Seller, or the Item is returned to the Seller unsold. The cost of such insurance shall be paid by the Buyer.  

9. The Seller warrants to The Shrew:  

(a) that the Seller is the sole legal owner of the Item free of any third  

party rights or claims; 

 

(b) the Seller has complied with all requirements, legal or otherwise relating to  

any export or import of the Item and has notified The Shrew in writing of any failure by third parties to comply with such requirements in the past; 

(c) the Seller has notified The Shrew in writing of any material  

alterations to the Item of which the Seller is aware and of any concerns expressed by third parties in relation to the ownership, condition or attribution of the Item. (d) that no statements (including omissions) about the Item are  

known by or ought reasonably to be known by the Seller to be inaccurate or misleading, including undisclosed major repairs known to the Seller, the forgery of supporting documentation, deliberate mis-attribution, supplying a different item to the one pictured & described or any other such act or omission.  

10. The Seller will indemnify The Shrew and/or the Buyer in full on demand  

against all claims, costs or expenses incurred by us or the Buyer as a result  

of any breach of the warranties set out in clause 9, whether arising in relation to the item or the proceeds of sale.  

11. The Shrew may suggest alterations to the description of the Item at any time prior to sale. While these are not mandatory, The Shrew will have complete discretion to refuse any Item it believes to be misrepresented in any way.  

12. The Shrew will pay the Seller the net sale proceeds (after deducting  

commission, VAT and any other agreed costs) within 5 days after the Transaction is completed. Payment will be made in sterling unless the Seller instructs otherwise in writing. If the Seller requires payment other than in sterling, The Shrew shall charge the Seller for any currency conversion costs and bank transfer fees incurred. Sale proceeds will be calculated at the rate of exchange quoted to us by Starling Bank prevailing on the day of the payment. Our certificate as to such rate will be conclusive.  

13. In the event of a return, the Seller is entitled to the return of the whole of the Item in the condition it was sent without any costs.  

Photographs and Illustrations  

14. The Shrew shall have the right (on a non-exclusive basis) to  

photograph, video or otherwise produce an image of the Item. All rights in such images will belong to The Shrew, and we shall have the right to use them in whatever way we see fit.  

​VAT  

​15. The Seller will give all relevant information about his VAT status and that of  

the Item to ensure that the correct information is made known to Buyer. If  The Shrew incurs any unforeseen cost or expense as a result of the information being incorrect, the Seller will reimburse to Us on demand the full amount incurred.  

Conditions Applicable to both Buyers and Sellers  

​Copyright  

​1. The copyright in all images, illustrations and written material relating to  

an Item is and shall remain at all times the property of The Shrew and shall not be used by the Buyer nor anyone else without our prior written consent. Where the Seller provides the text, photographs and illustrations for publication the Seller warrants that use is authorised by the copyright owner and indemnifies The Shrew against claims and costs arising from wrongful use.  

 Notices  

​2. Any notice given under these Conditions is to be in writing and, if given by post, will be taken to have been received by the addressee on the second working day after posting or, if the addressee is overseas, on the fifth working day after posting. Notice may also be given by email and shall be deemed to have been received on the next working day after transmission.  

​Severability  

​3. If any part of these Conditions of Business is found by any court to be invalid, illegal or unenforceable, that part may be discounted and the rest of the conditions shall continue to be valid and enforceable to the fullest extent permitted by law.  

Law and Jurisdiction  

​4. These Conditions of Business are subject to English law, which shall  

apply to their construction as well as to their effect. The Seller and the Buyer submit to the exclusive jurisdiction of the English courts.  

​Data Protection  

​5. In connection with the management and operation of our business and  

the marketing and supply of services, or as required by law, We may ask Buyers or Sellers to provide personal information about themselves or obtain information about Buyers or Sellers from third parties (e.g., credit information). If Buyers or Sellers provide The Shrew with information that is defined by law as “sensitive”, they agree that We may use it for the above purposes. The Shrew will not use or process sensitive information for any other purpose without Your express consent. If You would like further information, would like to make corrections to Your information or would prefer not to receive details of future events, please contact us at admin@the shrewshop.com. In order to fulfil the services You have requested, The Shrew may disclose information to third parties (e.g., shippers). Some countries do not offer equivalent legal protection of personal information to that offered within the UK. It is our policy to require that any such third parties respect the privacy and confidentiality of Your information and provide the same level of protection for Your information as provided within the UK, whether or not You are located in a country that offers equivalent legal protection of personal information. By agreeing to these Conditions of Business, You agree to such disclosure.

 7. This policy (together with our terms of use and any other documents  

referred to on it) sets out the basis on which any personal data we collect from You, or that You provide to us, will be processed by Us. Please read the following carefully to understand our views and practices regarding Your personal data and how We will treat it.

(b) If you contact Us, we may keep a record of that correspondence. We  may also ask You to complete surveys that We use for research purposes, although You do not have to respond to them. 

(c) Details of Your visits to our site and the resources that you access.  

IP addresses and cookies  

10. We may collect information about Your computer, including where  

available Your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.  

11. For the same reason, We may obtain information about Your general  

internet usage by using a cookie file which is stored on the hard drive of Your computer. Cookies contain information that is transferred to Your computer’s hard drive. They help us to improve our site and to deliver a better and more personalised service. They enable Us:

12. You may refuse to accept cookies by activating the setting on Your

13. Please note that our advertisers may also use cookies, over which We

Where We store your personal data.

destination outside the UK. It may also be processed by staff operating outside the UK who work for Us or for one of our suppliers. 15. All information You provide to Us is stored on our secure servers. Any  

payment transactions will be encrypted using appropriate technology. Where We have given you (or where you have chosen) a password which enables You to access certain parts of our site, You are responsible for keeping this password confidential. We ask You not to share a password with anyone.  

16. Unfortunately, the transmission of information via the internet is not  

completely secure. Although We will do our best to protect Your personal data, We cannot guarantee the security of Your data transmitted to our site; any transmission is at your own risk. Once We have received your information, We will use strict procedures and security features to try to prevent unauthorised access.  

17. We may ask for additional personal data from You for the specific  

purposes of verifying Your identity. If this data is requested We will ensure all additional data is deleted after a period of 35 days.

24. You have the right to ask us not to process Your personal data for  

marketing purposes. We will usually inform You (before collecting Your data) if We intend to use your data for such purposes or if We intend to disclose Your information to any third party for such purposes.
